LIMESTONE CO., Ala. (WAFF) — The trial of Dillon Herrington, known as the "Maga lumberjack," began today in a Limestone County courtroom after he was charged with having sex with someone unable to give consent due to being helpless or mentally incapacitated. Herrington appeared before Judge David Proctor this morning for preliminary proceedings.

The case against Herrington has been marked by recent legal maneuvering as his defense team filed motions over the weekend seeking to dismiss the charges based on newly released evidence from prosecutors, including drug test results and medical exam photos of the alleged victim. Additionally, texts between Herrington and the victim have also come into play during this pre-trial phase.

Herrington gained notoriety in 2021 when he threw a piece of lumber at Capitol Police officers during the January 6th riot at the U.S. Capitol. He later pleaded guilty to assaulting federal law enforcement but was pardoned by former President Trump last year, adding another layer of complexity to his current legal situation.

The trial is expected to delve into details surrounding Herrington's actions and the evidence presented by both sides as they attempt to establish their cases in what has become a highly publicized incident.
