Nenagh, Co Tipperary – On Monday, Gary Byrne (36) and James Reilly (49), both convicted sex offenders who are civil partners, were sentenced to ten years each by Justice Tony Hunt at the Central Criminal Court following a trial earlier this year. The men had been found guilty of two counts of sexual assault and one count of attempted anal rape against an unnamed victim in 2016.
The case involved a series of assaults that began on the street, where Byrne and Reilly sexually assaulted their then-19-year-old male victim before luring him to their home under false pretenses. Once inside, they administered an intoxicating substance, rendering the victim unable to move while they proceeded with further sexual assault attempts.
Justice Hunt emphasized the severity of the crime due to its aggravated nature: the use of incapacitating substances and the coordinated actions of both offenders, which led to severe harm for their victim. The judge noted that Byrne and Reilly showed no remorse during their trial proceedings and highlighted previous convictions for similar offenses by both individuals, including sexual assault against a teenage boy in 2020.
In his statement read before sentencing, the injured party described enduring psychological trauma following the assaults, which included feelings of self-hatred, loss of identity, and severe depression. He expressed hope that sharing his story would encourage other male victims to come forward, stating, "You are not alone. You will be heard."
Justice Hunt imposed strict conditions on Byrne and Reilly’s release after serving their sentences, including a three-year post-release supervision order during which they must engage with the Probation Service. Additionally, both men were ordered never to have any contact with the victim in future.
The court proceedings underscored the significant impact of such crimes not only on victims but also on broader public safety concerns highlighted by Justice Hunt’s remarks about "propensity and risk" posed by repeat offenders like Byrne and Reilly.
